Terms and condition

Session Etiquette.

* Members purchase yoga packages with agreement to follow the session and the batch timings which are allotted to the member during the enrollment. The batch timings cannot be rescheduled or changed once accepted by the member unless agreed in advance on invoice and confirmed on email by the instructor. The number of sessions in a week is scheduled on the basis of the package purchased by the member.
* The maximum duration of each session will be 60 minutes.
* The Member will strictly follow all instructions issued by the Instructor during the Yoga Session.
* The membership package entitles the member to a specific number of yoga sessions, which must be used within the membership term.
* Membership fees must be paid in advance.

Prerequisites

* The member need not have any prior experience of yoga.
* There is no age limit to join the Yoga sessions.
* Student must take responsibility for their decision to join Yoga considering their previous health ailments/ chronic disorders etc., if any.
* In case of a serious medical condition, a doctor’s approval should be submitted before the enrollment.
* However, the member must be responsible enough to attend the sessions regularly and to abide by the Terms & Conditions.

Precautions before practicing yoga include

* Avoiding heavy meals: Eating a large meal right before yoga can cause discomfort during practice. Opt for a light snack if necessary, or practice on an empty stomach if you can.

* Staying hydrated: Drink water before your yoga session to ensure proper hydration, but avoid drinking large amounts immediately before practice to prevent discomfort.

* Dressing comfortably: Wear breathable, comfortable clothing that allows for easy movement and doesn’t restrict your breathing or circulation.

* Emptying your bladder: Use the restroom before starting your yoga session to prevent interruptions during practice.

* Checking for injuries or health concerns: Assess your physical condition before starting yoga. If you have any injuries, chronic conditions, or other health concerns, consult with a healthcare professional or modify your practice as needed to avoid exacerbating any issues.

* Setting up your space: Arrange your yoga mat and any props you may need before starting your practice to create a comfortable and safe environment.

* Listening to your body: Pay attention to how you feel physically and mentally before starting yoga. If you’re feeling fatigued or unwell, consider taking a rest day or practicing gentle yoga instead of more vigorous styles.

* Practicing mindfulness: Take a few moments before starting your yoga practice to center yourself, focus on your breath, and set an intention for your practice. This can help you cultivate a deeper mind-body connection and enhance the benefits of your yoga practice.

Code of Conduct

* The member must respect the behavioural and operating principles and follow them on all occasions.
* Behaving in a friendly and respectful manner towards the other members as well as staff.
* Alcohol, tobacco, or any other addictive substances are prohibited, as is the consumption of food or beverages (excluding water) during the class.
* The instructor can be contacted ,if necessary , members can send messages to via watsapp.
* Inappropriate or abusive communication to the instructor or any fellow member in any form (verbal, SMS, mail or WhatsApp) will not be tolerated.
* Cell phones must be turned off or put on silent and kept away from the mat during class
* Please arrive at least 10 minutes before your scheduled session

POSTING PHOTOGRAPHS AND VIDEOS ON SOCIAL MEDIA

* Trainees understand that Nihar Wellness engages in social media networking, such as Facebook, Flickr, Instagram, Google plus ,flickr, youtube, the company website etc. as part of the company’s promotional endeavors, which may involve sharing of photos or other information. By agreeing to these terms and conditions trainees give full permission for this information to be released.• If trainees are uncomfortable with this please make this explicitly known to the staff via email.
* By signing up, you agree to share your contact number and email for receiving communications from Nihar Wellness via SMS, WhatsApp, and phone calls.
* Nihar Wellness takes the privacy and security of our trainees and their personal information very seriously. Information collected is used strictly by us to provide our services to you and as is required for the provision of our services.

RENEWAL OF MEMBERSHIP

Members may choose to renew their membership one month prior to its expiry date.
However, the expiry date of any membership is always the last day and last session of the membership period.

FROZEN MEMBERSHIP

Freezing of membership is applicable only for Pregnancy, (duration : 9 months) and for severe medical conditions (Duration 6 weeks).
Medical Reports & Certificates to be submitted, once approved can avail the same.

Cancellation / Transfer of Membership

* Once the membership fee is paid, it cannot be cancelled or refunded.In the event that more than half of the training is completed, no refunds will be issued.

* Where an enrollment is cancelled by a trainee for any reason, the deposit is not refundable. Transfer of deposit to another training , for exceptional reasons, will be at the discretion of Nihar Wellness . 

Online classes

* In case of one on one personal training session – a class is defined as NO SHOW if the User has not joined the class within 10 minutes of the scheduled start time, the class may be cancelled, without any compensatory class and will be treated as a missed class and will be fully chargeable.

* However, with a prior written notice of 48 hours communicated to the instructor, will help User reschedule the class depending on the availability and schedule of Company’s coaches. in case of online personal training session.

* For NO SHOW due to technical issues, Nihar Wellness will arrange for compensatory classes if the user has reached out to the instructor before the scheduled classes.

* Users under 18 must have their registration information verified by parents or guardians and may only access the Services under their supervision.

 Medical Disclaimer

* Before starting any yoga or other exercise program through the Service, the User may consult his/her physician to determine if such program is right for the User’s needs
* Users are responsible for assessing their own physical and mental capabilities for activities.
* Users must ensure they do not exceed their limits during activities and select appropriate levels for their skills, abilities, and any conditions or limitations they may have.
* Users are responsible for determining if suggested physical adjustments or equipment usage are suitable for their abilities and condition.

Liability Waiver

* While our instructors take reasonable care, Nihar Wellness is not liable for any injuries or damages that may occur during yoga sessions.
* Nihar Wellness disclaims any liability for injuries ,illnesses, damages, or losses incurred during trainings, workshops, or retreats.
* Pregnant ladies must have obtained clearance from their healthcare provider to engage in physical activity and acknowledge the risks associated with prenatal yoga, understanding that the program organizers and instructors bear no liability for any resulting injuries or complications.

Transaction Summary

Users will receive payment receipts and transaction summaries from either the mobile app marketplace or the online bank account, which will be sent to their registered email address.

User Comments and Suggestions
The Company values user feedback and encourages users to provide specific comments.

Intellectual Property

* The Company asserts exclusive ownership of its name, trademarks, and all elements of its Services, including software, media, design, content, and trademarks, protected by copyright and trademark laws, with Users acknowledging the Company’s retention of all rights to its Services and content.
* Users are prohibited from selling, modifying, reproducing, displaying, or distributing the Services in any way for any purpose.
* All materials, such as training manuals and website content, are the exclusive property of Nihar Wellness.
* Unauthorized use of these materials for financial gain is strictly prohibited.

Acceptance of Terms

These terms and conditions shall be governed by and construed in accordance with the laws of [jurisdiction], and any disputes arising out of or related to the program shall be resolved in accordance with these laws.

Participation in the yoga program constitutes acceptance of these terms and conditions.

Participants are encouraged to read these terms and conditions carefully before enrolling in the program.
